日本住宅宿泊事業法《民泊新法》,開放位於住居專用地域(1)的住宅(2)可作為民泊
出租,解除住宿日限制(3),申報即可(4),但每年營業日數上限180日(5),且各地
方自治体得為更嚴格的規定(6)。
(1) 旅館業法禁止
(2) 旅館業法規定建物用途須為旅館
(3) 如大阪市民泊條例限制二夜以上
(4) 旅館業法採許可制
(5) 旅館業法無營業日數限制
(6) 如東京荒川區僅允許民泊在六日或國定假日正午至隔日正午期間營業。
另部分地方的條例不開放住專地域 ,如神戶市除北區有馬町外,全部住專地域禁止民泊
;東京大田區全區住專地域禁止民泊。
因此關於住宅宿泊詳細的營業限制,得去看各自治体的住宅宿泊条例,實在太多了只找了

房東未取得旅館業法簡易宿所營業許可,違反旅館業法第3條,成立同法第10條之罪,處
六個月以下一個月以上懲役,或 科或併科100萬以下罰金
b. 民泊新法允許地方制定更嚴格的營業限制規定,但地方也可不作規定,此時該地區民
泊依民泊新法原則規定(每年180日)
c. 僅少數地方在其條例內有針對違反其營業限制制定明確罰則,如渋谷區、奈良縣/市
d. 民泊違反地方的營業限制,新宿區役所6月發行的「新宿区住宅宿泊事業ルールブック
」第7頁,認為這種情形業者也可成立旅館業法第10條之罪
